Prior to using qoala on www.qoala.io and/or other domains and services ran by qoala.io, (the “ Service”) you should read the following terms and conditions. These Terms of Service (the “Terms”) are a legal agreement between you and the operator of qoala.io services pixels & things Oy (the “Provider”).
Welcome to Qoala.io (the “Service”). Please read the Terms before using the service. You comply to
these Terms by accessing or using the Service. Do not use the service if you do not accept the
Qoala.io holds the right to modify these terms or any additional that apply to the Service, for
example, but not limited to, reflect changes to the law or changes to the Service. We will not
reduce your rights under these Terms without your explicit consent. We will post any changes in the
Terms on this page and ask for your consent specifically via an email notification. Changes will not
apply retrospectively and will become effective no earlier than fourteen days after they are posted.
However, changes addressing new functions or features for the Service or changes made for legal
reasons will be effective immediately. If you do not agree to the modified terms for the Service,
you should discontinue your use of that service.
If there are any inconsistencies between these terms and additional terms, the additional terms will prevail to the extent of the inconsistencies. These terms govern the relationship between the qoala.io service and you. They do not create any third party beneficiary rights. If you do not comply with these terms and we do not take action immediately, this does not mean that we are giving up any rights that we may have. If a particular term is not enforceable, it does not affect any other terms.
The laws of Finland will apply to any disputes arising out of or relating to these Terms of Service. All claims arising out of or relating to these Terms or the Service, that cannot be agreed upon by means of negotiation between the parties will be litigated in the district court of Helsinki, Finland.
The qoala.io service has two types of users:
To use the Service as an Organizer, you can use the Service in two different ways: without creating an account (“Anonymous user”) or by creating an account (“Registered user”). To use the Service as a Participant, you do not need to create an account or register as a user. Instead, you can join the event created by the Organizer via a code.
You must follow any policies made available to you within the Service.
Do not misuse the Service, for example, do not interfere with the Service or try to access it using a method other than the interface and the instructions provided by us. You may use the Service only as permitted by law, including applicable export and control laws and regulations. We may suspend or stop providing the Service to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Using the Service does not give you ownership of any intellectual property rights in the Service or the content that you access. Any content from the Service may not be used unless you obtain permission from its owner or are otherwise permitted by law.
In connection with your use of the Service, we may send you service announcements, administrative messages and other information. You may opt out of some of those communications. The Service is available on mobile devices. Do not use the Service in a way that distracts you and prevents you from obeying any traffic or safety laws.
The Service allows you to upload, submit, store, send or receive content. You retain ownership of any
intellectual property rights that you hold in that content.
When you send or receive content through the Service, you give Qoala a worldwide licence to use, host, store, reproduce, modify and distribute such content. The licence is for the limited purpose of operating and improving the service. The licence continues even if you stop using the Service. The licence does not include the use of personal data. The content used for the limited purpose of operating and improving the service will be anonymised before use.
Qoala.io stores your active session info in order to prevent unauthorized access to your information. This session information may include but is not limited to: device MAC address, IP address, and browser information.
Qoala.io is constantly developing, improving and changing the Service. Qoala.io may add or remove features or functionalities and may suspend or stop the Service altogether. You can stop using the Service according to the service agreement. Qoala.io may also stop providing the Service to you or add or create new limits to the Service any time.
Other than as expressed in these terms or additional terms, neither Qoala.io nor suppliers nor
distributors makes any specific promises about the Service. For instance, Qoala.io does not make any
commitments about the content within the Service, the specific functions of the service or their
reliability, availability or ability to meet your needs. The Service is provided “as is”.
To the extent permitted by law, Qoala.io exclude all warranties.
Qoala.io and Qoala.io’s suppliers and distributors will not be responsible for lost profits,
revenues, data, financial losses or indirect, special, consequential, exemplary or punitive damages.
The total amount of liability of Qoala.io and its suppliers and distributors for any claims under these terms, including for direct damages, is limited to the amount that you paid for the use of the Service. If you use the service for free, qoala.io and its suppliers and distributors shall not be responsible for any direct damage.
Qoala.io and qoala.io’s suppliers and distributors shall not be responsible for the destruction, disappearance or alteration of your information, files or data or any costs arising from this, such as costs arising from the recreation of the information, files or data.
